Lesbian mother fends off antigay attack
Last week Victoria Moses emerged victorious from a custody battle for her daughter in the Georgia Court of Appeals. The court ruled that lesbian and gay parents cannot have their custody or visitation rights changed because of their sexual orientation without showing a negative impact on the child.
Moses’s battle began in 2004, when the father of her child sued for a change in custody after being held in contempt for not paying child support for more than a year and a half.
When a different judge realized that Moses was a lesbian and that she was living with her partner, the judge awarded custody to the deadbeat dad. That’s when Lambda Legal stepped in.
Armed with this victory, all gay and lesbian parents in Georgia can now breathe a little easier, knowing their sexual orientation alone cannot be used to separate them from their children.
